LIMITED WARRANTY POLICY AND DISCLAIMERS

KAI CONCEPTS, LLC (hereinafter referred to as “KAI CONCEPTS”) Warrants this product to be free of major defects in material or workmanship to the original purchaser for a period of one year from the original date of purchase, or unless otherwise specified below. The product warranty is valid only for personal use and does not cover use in rental, surf school, formal teaching operations, and/or other types of commercial use. No other express or implied warranty is given.

KAI CONCEPTS will make the final warranty determination, which may require inspection and or photos of the equipment, which clearly show the defect(s). If necessary, information and or the product may be required to be sent to KAI CONCEPTS, postage prepaid.

If a product is deemed to be defective by KAI CONCEPTS, the warranty covers the repair or replacement of the defective product only, and does not cover reimbursement for labour, or other incidental costs. The warranty covers defects in material or workmanship from the date of purchase, for:

• One year for the JETFOILER™ board, strut, motor and drive unit.
• Two years for the JETFOILER™ wings, and fuselage.
• The earlier of one year or 300 cycles for the JETFOILER™ battery.
• One year for the JETFOILER™ battery Smart Session™ Charger.
• One year for the JETFOILER™ remote, and remote charger.

KAI CONCEPTS will not be responsible for any costs, losses or damages incurred as a result of loss of use of this product. The warranty does not cover damage caused by misuse, abuse, neglect or normal wear and tear, including but not limited to:

• Damage caused by unauthorized modification or repair of the product.
• Damage caused by misuse as described in the product manuals.
• Failure to maintain the product as stated in the product manuals.
• Damage caused by modification using third-party components.
• Damage caused by using the product with an expended battery.
• Damage or fire due to a crash, dropping, or physical impact.
• Damage or fire resulting from user error.
• Damage or fire resulting from charging or use in unsafe locations.
• Damage or fire resulting from use in inclement weather.
• Damage caused by interference by other wireless devices.
• Damage caused by electromagnetic interference.
• Damage or loss of your personal data.
• Any software or firmware programs present on the product at purchase.
• Any software or firmware upgrades applied to the product after purchase.
• Damage caused by collisions, abuse, misuse or accident.
• Damage caused by transport, loading, or unloading.
• Damage caused by inappropriate storage as stated in the product manuals.
• Damage caused by exceeding stated operating or storage temperatures.
• Damage caused by prolonged exposure to direct sunlight.
• Damage caused by rental, surf school, or formal teaching operations.
• Damage caused from any other non-recreational use.
• Damage caused by using the product after a warranty issue was reported.
• Damage caused by using the product after a warranty issue should have reasonably been reported in the exercise of owner diligence.
• Damage caused by hail, rain, lightning, sand, flood, tornado, hurricane, or other natural conditions or Acts of God.
• Damage caused by unapproved cleaning products.
• Damage caused by unapproved maintenance procedures.
• Damage caused by unapproved disassembly or assembly procedures.
• Any other damage except defects in material or workmanship.

The warranty for any repaired or replaced equipment is good from the date of the original purchase only. The original purchase receipt must accompany all warranty claims. There are no warranties that extend beyond the warranty specified herein.

You additionally acknowledge and agree that the limited warranty for this JETFOILER™ product is further subject to: (I) KAI CONCEPTS, LLC (“Kai Concepts”) Release of Liability, as published on the JETFOILER™ website at jetfoiler.com/release-of-liability; and further subject to (II) KAI CONCEPTS, LLC (“Kai Concepts”) Terms of Use, as published on the JETFOILER™ website at jetfoiler.com/terms-of-use.

WARRANTY CLAIMS

Warranty claims must be processed and be issued a return authorization prior to shipping to KAI CONCEPTS. Domestic or international shipping costs may apply.
